3. AI Signals and Algorithmic Content Disclaimer

GoldTracker.ai provides AI-generated trade signals, market briefs, risk assessments, and other algorithmic outputs ("AI Content"). By using the Service, you acknowledge and agree that:

• AI Content is generated by computer algorithms based on historical market data, technical indicators, and statistical models. It is NOT personalized financial advice.
• AI Content is NOT guaranteed to be accurate, complete, or timely. Algorithms may produce errors, false signals, or misleading outputs.
• Past performance of AI signals does not guarantee future results. Historical accuracy rates are not predictive of future accuracy.

4. Paper Trading Disclaimer

GoldTracker.ai offers a virtual paper trading feature for educational and practice purposes. You acknowledge and agree that:

• Paper trading uses simulated capital and does NOT involve real money or actual market execution
• Simulated or hypothetical trading results have inherent limitations and do NOT represent actual trading
• Paper trading results may differ materially from actual trading results due to factors including but not limited to: slippage, liquidity constraints, market impact, execution delays, spread variations, and emotional factors
• No representation is made that any account will or is likely to achieve profits or losses similar to those demonstrated in paper trading
• Paper trading does not account for the financial risk of actual trading and cannot fully account for the impact of financial risk in actual trading

5. Data Accuracy and Third-Party Sources

Market data, news, economic indicators, and other information displayed on GoldTracker.ai are sourced from third-party providers including, but not limited to, Polygon.io, TwelveData, FRED (Federal Reserve Economic Data), and Benzinga. While we strive to provide accurate and timely information:

• We do NOT guarantee the accuracy, completeness, timeliness, or reliability of any data or information provided
• Data may be delayed, inaccurate, or contain errors; real-time data is not guaranteed
• We are not responsible for any errors, omissions, or inaccuracies in third-party data
• Prices displayed may differ from actual market prices at the time of trade execution
• Service disruptions, data feed interruptions, and technical outages may occur without prior notice
• You should independently verify all data before making any trading or investment decisions

6. User Responsibilities and Eligibility

By using GoldTracker.ai, you represent and warrant that:

• You are at least 18 years of age (or the age of majority in your jurisdiction)
• You are solely responsible for all investment and trading decisions you make, regardless of any information obtained through the Service
• You have sufficient knowledge and experience to evaluate the merits and risks of any trading decision
• You understand the risks involved in trading financial instruments and are financially able to bear such risks
• You should consult with a licensed and qualified financial advisor, broker, or other professional before making any trading or investment decisions
• You will comply with all applicable laws and regulations in your jurisdiction regarding trading and investing
• You will maintain the confidentiality of your account credentials and are responsible for all activities under your account
• You will not use the Service for any illegal or unauthorized purpose

7. Subscription Terms

7.1 Free Trial

GoldTracker.ai may offer a free trial period for new users. At the end of the free trial, your account will automatically convert to a paid subscription unless you cancel before the trial period ends. You will be notified before any charges are applied.

7.2 Auto-Renewal

Paid subscriptions automatically renew at the end of each billing period (monthly or annually) at the then-current subscription rate. By subscribing, you authorize us to charge your payment method on file for each renewal period.

7.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods. You will retain access to paid features until the end of your current billing cycle.

7.4 Price Changes

We reserve the right to change subscription prices at any time. Existing subscribers will be notified at least 30 days before any price increase takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.

8. Account Termination

We reserve the right to suspend, restrict, or terminate your account and access to the Service at our sole discretion, at any time, and without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Non-payment of subscription fees
• Sharing account credentials or unauthorized access
• Any conduct we deem harmful to other users or the Service

Upon termination, your right to use the Service immediately ceases. We are not liable to you or any third party for any termination of your access to the Service.

9. Limitation of Liability

IN ANY EVENT, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT OF SUBSCRIPTION FEES ACTUALLY PAID BY YOU TO GOLDTRACKER.AI DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID ANY FEES, OUR MAXIMUM LIABILITY SHALL BE LIMITED TO FIFTY U.S. DOLLARS (USD $50.00).

This limitation of liability applies to all causes of action in the aggregate, including but not limited to breach of contract, breach of warranty, negligence, strict liability, misrepresentation, and any other torts.

10. Indemnification

You agree to indemnify, defend, and hold harmless GoldTracker.ai, its owners, officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in connection with:

• Your use of or inability to use the Service
• Any trading or investment decisions you make based on information obtained through the Service
• Your violation of these Terms of Service
• Your violation of any applicable law, rule, or regulation
• Your violation of any rights of a third party
• Any content you submit or transmit through the Service

11. Intellectual Property

All content, features, functionality, trademarks, logos, data compilations, software, text, graphics, and other materials on GoldTracker.ai are the exclusive property of GoldTracker.ai or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from any content on the Service without prior written consent.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

14. Modification of Terms

We reserve the right to modify, update, or revise these Terms of Service at any time at our sole discretion. Material changes will be communicated by posting the updated terms on the Service and updating the "Last Updated" date. Your continued use of the Service after any modifications constitutes acceptance of the revised terms. It is your responsibility to review these Terms periodically.
